In-N-Out Menu respects the intellectual property rights of others and expects users of innnoutmenu.com to do the same. In accordance with the Digital Millennium Copyright Act of 1998, we will respond promptly to claims of copyright infringement that are reported to our designated agent identified below.
1. Reporting a Copyright Infringement
If you are a copyright owner, or authorized to act on behalf of one, and you believe that material posted on this website infringes your copyright, you may submit a written notice of copyright infringement. To be effective, your notice must include substantially the following information as required by 17 U.S.C. § 512(c)(3).
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notice, you may include a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material. This typically includes the full URL where the material appears on innnoutmenu.com.
- Information reasonably sufficient to allow us to contact you, including your full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

2. How to Submit a DMCA Notice
DMCA notices should be sent to our designated agent by email at the address shown below. Please use the subject line “DMCA Takedown Notice” to ensure timely review.

We aim to acknowledge receipt of valid DMCA notices within two business days and to act on properly submitted notices within ten business days, although response times may vary depending on the complexity of the claim.
3. Counter Notification
If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter notification. To be effective, your counter notification must include substantially the following information as required by 17 U.S.C. § 512(g)(3).
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your full name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the site operator may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, In-N-Out Menu has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or contributors who are deemed to be repeat infringers. We may also at our sole discretion limit access to the website or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
5. Warning About False Claims
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorney fees, incurred by the alleged infringer, the copyright owner, or the service provider as a result of the misrepresentation.

6. Trademark and Fair Use Note
In-N-Out Menu is an independent fan website. References to In-N-Out Burger, menu item names, and related trademarks are used under the principle of nominative fair use. All such trademarks remain the property of In-N-Out Burgers, a California corporation. We have no commercial affiliation with In-N-Out Burger.
7. Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting on this page. We encourage you to review this policy periodically.
